All content, trademarks, and intellectual property on our website are owned by or licensed to us. For project deliverables, intellectual property rights will be transferred upon full payment unless otherwise agreed in writing.
1) Portfolio Rights (Bongz Tech Website and Marketing)
Bongz Tech retains the unrestricted right to display completed client work in Bongz Tech's own portfolio, case studies, social media, presentations, and other marketing channels. This includes project name, logo, screenshots, and a brief project description.
2) On-Site Credit (Client Website)
A footer/site credit such as "Designed by Bongz Tech" or "Developed by Bongz Tech" will be added to the client's website by default.
3) Client Opt-Out / Removal (Client Website Only)
If the client does not want this on-site credit, the client may request in writing that: (a) the credit not be added, or (b) the credit be removed after go-live. Bongz Tech will action such written request within a reasonable timeframe.
4) Scope Clarification
Any opt-out or removal request applies only to credit on the client's website and does not limit Bongz Tech's rights to showcase the project on Bongz Tech's own platforms.
Service fees will be specified in project proposals or invoices. Payment terms are net 14 days unless otherwise agreed. Late payments may incur interest at the maximum rate allowed by South African law.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising from your use of our Services.
You agree to indemnify and hold harmless BONGZ TECHNOLOGIES (PTY) LTD from any claims, damages, liabilities, and expenses arising from your use of our Services or violation of these Terms.
We may terminate or suspend your access to our Services immediately, without prior notice, for any breach of these Terms.
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts of Gauteng.
We reserve the right to modify these Terms at any time. The updated version will be posted on our website with a revised "Last Updated" date.
